1. ACCEPTANCE OF TERMS

These Terms and Conditions (“Agreement”) govern the purchase and use of Seam-Mate products by distributors, contractors, and end-users (collectively, “Purchasers”). By placing an order for any Seam-Mate product, Purchasers expressly acknowledge and agree to the following:

  • They have read, understood, and accepted the Seam-Mate How to Manual and all accompanying installation guidelines, including online video tutorials.
  • They will follow all installation instructions exactly as provided, without deviation.
  • They will use only the Seam-Mate Adhesive provided in the kit. Substituting adhesives or using third-party materials is strictly prohibited and will void all warranties.
  • They assume all liability for improper installation, misuse, or failure to adhere to the required safety guidelines.

Failure to comply with these Terms and Conditions will release Seam-Mate from any responsibility, liability, or warranty obligations.

2. PRODUCT USE AND INSTALLATION REQUIREMENTS

2.1 Mandatory Use of Seam-Mate Components

Each Seam-Mate kit includes:

  • Two (2) 64” Seam-Mate rails (one pair)
  • One (1) bag of #6 1-1/4” screws (50 pcs)
  • Ten (10) Seam-Mate finishing clips
  • One (1) tube of Seam-Mate Adhesive
  • Step-by-step installation manual

Purchasers must use all provided components and must not substitute any part with third-party materials.

2.2 Installation Guidelines

Purchasers must follow the exact step-by-step installation process outlined in the Seam-Mate instruction manual and online tutorial, including but not limited to:

  1. Confirming Level Alignment – Before securing rails, both surfaces must be properly aligned and verified as level.
  2. Routing & Sanding – A router must be used to trim 10-20 thousandths of an inch from the seam edges, followed by sanding to achieve a smooth finish.
  3. Adhesive Application – Seam-Mate Adhesive must be applied only to the designated areas as indicated in the instructions. Failure to use Seam-Mate Adhesive or applying it incorrectly will result in seam failure.
  4. Fastening Components – All screws and clips must be installed as directed.
  5. Final Dri-Fit & Alignment – The countertop must be dry-fitted before final installation to ensure proper seam alignment.
  6. Cure Time Compliance – Seam-Mate Adhesive has a maximum of five (5) minutes of working time and a cure time of 10-15 minutes. The seam must remain undisturbed during this period.

Failure to adhere strictly to these procedures will void all warranties and release Seam-Mate from liability.

3. SAFETY REQUIREMENTS

Purchasers acknowledge that they are responsible for using appropriate personal protective equipment (PPE) during installation, including:

  • Safety glasses or face protection
  • Gloves
  • Protective clothing as necessary

Seam-Mate is not liable for injuries, damages, or health issues arising from the failure to wear appropriate PPE during installation.

4. WARRANTY AND LIMITATION OF LIABILITY

4.1 Limited Warranty

Seam-Mate warrants its products only when used in strict accordance with the How to Manual and installation instructions. This warranty covers manufacturing defects but does not cover damages caused by:

  • Failure to follow Seam-Mate’s installation instructions
  • Use of non-Seam-Mate adhesive or third-party components
  • Improper handling, misuse, or alterations to the product
  • Failure to comply with safety requirements

If a Purchaser believes a product is defective, they must notify Seam-Mate within 30 days of purchase with documented proof of compliance with installation requirements.

4.2 Disclaimer of Liability

Seam-Mate is not responsible for and expressly disclaims liability for:

  • Any damage, injury, or loss resulting from improper installation, third-party modifications, or failure to follow instructions
  • Any damages arising from the use of non-Seam-Mate adhesives or substitute materials
  • Any personal injury due to the failure to wear safety glasses, gloves, or other PPE

By accepting these Terms and Conditions, Purchasers waive any claims against Seam-Mate related to improper installation or deviation from provided guidelines.

5. COMPLIANCE & INSPECTIONS

Seam-Mate reserves the right to:

  • Audit installation practices of Purchasers at its discretion
  • Terminate agreements with distributors who repeatedly fail to comply with installation requirements
  • Refuse warranty claims from any Purchaser who cannot provide proof of proper installation

Seam-Mate may require photo or video evidence of proper installation procedures for warranty verification.

6. MODIFICATIONS AND AMENDMENTS

Seam-Mate reserves the right to modify these Terms and Conditions at any time. The most current version will be made available on seam-mate.com, and Purchasers agree that continued use of Seam-Mate products constitutes acceptance of any modifications.

7. DISPUTE RESOLUTION AND GOVERNING LAW

  • Any disputes arising from the use of Seam-Mate products shall be governed by and construed under the laws of [Your State].
  • Purchasers agree to attempt an amicable resolution before pursuing legal action.
  • If resolution cannot be reached, disputes shall be settled in [Jurisdiction of Choice], with all legal costs borne by the non-prevailing party.

8. ACKNOWLEDGMENT AND AGREEMENT
